Any use of the Smart Gift Solutions website is subject to the user agreeing to the following Terms and Conditions.
These conditions shall apply to all online transactions between Smart Gift Solutions (“Smart Gift Solutions”) and any person, firm or company (“the Purchaser”) placing an order online with Smart Gift Solutions for the manufacture and/or supply of any goods (“the Goods”). Smart Gift Solutions, by accepting any order for Goods from the Purchaser, agrees to sell and the Purchaser agrees to purchase such Goods at the price stated on Smart Gift Solutions website and on the sole basis of the terms and conditions of Smart Gift Solutions stated herein.
Prices for Goods include Smart Gift Solutions standard packaging, VAT
(VAT No: 810 0479 68) and postage or carriage.
In the unlikely event that an incorrect price is shown on our website, Smart Gift Solutions reserves the right to abstain from fulfilling the order at that price. The customer will be notified by email informing them of the correct price, and given the choice to proceed with the order.
2. SECURE ONLINE PAYMENT
Smart Gift Solutions provides a secure payment system. Payments can be submitted online using protocol 128 bit SSL (Secure Socket Layer), the strongest commercially available level of encryption. The private data of the Purchaser will be encrypted at all times whilst in transit over the Internet. The Purchaser should see a solid yellow padlock in their browser status bar which indicates that the encryption is taking place. Credit card payments can be made using Visa, Mastercard, Eurocard, Delta, American Express, Switch and Solo.
Goods will only be despatched once payment has been received in full.
Smart Gift Solutions will endeavour to despatch orders within 24 hours of receipt (on week days only). The delivery prices listed on the web site include a Next Day delivery service within the UK mainland (Monday to Friday only). Orders must be received by 2pm the latest for this service. Delivery to the Scottish Highlands and outside the UK mainland will be between 2-5 days, depending upon the destination.
Our Next Day Guaranteed Delivery Service means that should an error on our part, or events outside of our control, prevent your parcel being delivered within the time frame expected a full refund will be provided for your shipping costs.
For all other delivery services we will make every effort to deliver within the time stated but we will not be liable for any loss caused to you by late delivery. If your gift is not delivered within the estimated delivery time which we quote, please contact us by telephone or email and we will do our utmost to ensure that your gift is received as quickly as possible.
All deliveries are required to receive a signature in order to complete the delivery. If the recipient is not at home on the first delivery attempt made by Parcel Force a second attempt at delivery will be made on the following working day. If, again, the recipient is not at the stated address to receive their parcel, a card will be posted for the recipient, indicating delivery has been attempted and requesting the recipient to contact the depot through the telephone number on the card to arrange a more suitable time for delivery or to have the parcel taken to their local Post Office. If there has been no response within 14 days Smart Gift Solutions will be notified of the situation. If Smart Gift Solutions is unable to rectify the problem, having tried to make contact with the Purchaser, then the Goods will be returned to Smart Gift Solutions. Thereafter, the Purchaser will incur a redelivery charge to deliver the Goods again at twice the original cost, since Smart Gift Solutions will have incurred a return charge by the carrier. The Purchaser will also be charged for any items which have become unsuitable for sale and need replaced (mainly perishable items like smoked salmon and cheese which have short shelf lives).
Shortly after placing an order an automated email will be sent to advise the purchaser to track their order via www.smartgiftsolutions.co.uk. The purchaser will need to login to obtain a parcel tracking number which will be available on the date of despatch. At this point it becomes the responsibility of the purchaser to track their parcel. If a parcel has been delivered and signed for Smart Gift Solutions will not be alerted to any problems. All queries must be received within 3 working days of an expected delivery date.
3A. DELIVERY TO HOSPITALS AND HOTELS
Smart Gift Solutions need to state that deliveries to a hotel or hospital address may not be personally delivered to the requested recipient by Parcel Force (delivery agent). Smart Gift Solutions is restricted by the fact that many deliveries which are made to hotels or hospitals are made to a central delivery point such as the main reception, the concierge or the post room (central delivery point). Tracking may not be available for all deliveries. Royal Mail hospital deliveries are often delivered in 'one batch of parcels' which means individual parcel tracking is not possible.
Regrettably, it is impossible for Smart Gift Solutions to be responsible for the actions of other people working within the hotel or hospital where delivery is being made. Smart Gift Solutions part in the delivery process has been completed once a gift has been delivered to and received by a member of the staff at the central delivery point. Smart Gift Solutions are unable to influence or control the movement or rate of movement of a parcel within the hotel or hospital, especially to determine or guarantee how quickly they will be received by the recipient. It is the responsibility of the customer to telephone the hotel or hospital before ordering to inquire about their policies.
Although Smart Gift Solutions will try to help locate a gift which has not been received by the recipient within a hotel or hospital, we consider the limit of our guarantee and involvement finishes on proof of delivery to the central delivery point, not the recipient. Should you discover that the guest will not be arriving at the hotel or hospital on the date expected, will not be arriving at all, or has moved location within the hotel or hospital, regrettably Smart Gift Solutions will not be able to take responsibility for the parcel, it will become the responsibility of the person ordering the gift to advise the hotel or hospital on what action to take regarding their parcel.
4. COMPLAINTS/CUSTOMER SERVICE
The Purchaser should inform Smart Gift Solutions immediately of any problems by Telephone +44 (0)870 609 3448, Fax +44 (0)1892 615445 or Email email@example.com. Complaints are taken very seriously by Smart Gift Solutions and will be investigated as soon as they are brought to our notice. We will endeavour to rectify any problems as soon as possible. Please note that the Purchaser is also welcome to contact Smart Gift Solutions on any issue relating to their order on the contact telephone, fax or email listed above. Smart Gift Solutions operating hours are from 09:00am GMT to 17:00pm GMT, Monday to Friday only.
5. DAMAGED GOODS
If the Goods are damaged the Purchaser should contact Smart Gift Solutions within 3 days of receipt of Goods. Damaged Goods must be returned to Smart Gift Solutions, Unit 20, Colebrook Industrial Estate, Longfield Road, Tunbridge Wells, Kent TN2 3DG, suitably packaged. Smart Gift Solutions will replace or refund the items concerned including shipping costs.
Smart Gift Solutions reserves the right to substitute any items included in pre-made or customised hampers of similar or greater value, if for any reason those listed on the web site are unavailable.
No persons under 18 years of age may place an order or receive Goods from Smart Gift Solutions if the Goods contain alcohol.
8. FORCE MAJEURE
Smart Gift Solutions will exercise every reasonable effort to meet the requested despatch date. Smart Gift Solutions shall not, however, be liable for any loss or damage due to delays or failure to ship resulting from any cause beyond its reasonable control, such as, but not limited to, compliance with laws or regulations, acts of God, acts or omissions of the Purchaser, acts of civil or military authority, judicial action, defaults of sub-contractors or suppliers, labour disputes, failure or delays in transportation, embargoes, wars or riots.
9. ONLINE PRESENCE
No warranty is given by Smart Gift Solutions that their web site will be constantly online or free of defects and errors at any time.
Smart Gift Solutions collects the information provided by the Purchaser at the time of ordering and uses this information lawfully and in accordance with the Data Protection Act 1998. Information is collected by Smart Gift Solutions to process the Purchaser’s order and also to provide the highest level of customer service possible. Smart Gift Solutions will not email marketing material to the Purchaser unless prior consent has been obtained.
